Agreement is made at a time of separation when each party agrees terms as if there were a final divorce, with the intention that they will be binding on them on the later divorce. Provided there has been disclosure, legal representation and no duress, misrepresentation or mistake, it is very likely that a court on the later divorce will make an order in the terms agreed.

Well there had to be some Latin somewhere. This means a hearing without the other party present. Used in matters of emergency and followed a few days or so later by a fuller hearing. Often now called “without notice”, which seems much too boring!
